Marketing Engines, Inc. is the provider of every service described on this site. That includes the free tools and the paid work.
James Tyler is the person doing the work. The contract is with the company.
Using this site
You may read this site and use the free tools. Do not attempt to break, overload or gain unauthorised access to it.
The words, code and images here belong to Marketing Engines, Inc.. You may quote a short passage with a link back.
The CRM Score is free and informational
The CRM Score is free. It asks you questions and returns a score, with a short list of suggested changes.
It is information, not advice. A formula generates it from your own answers. Nobody reviews it before you see it.
Do not rely on it as professional, legal or financial advice. Decide for yourself what to act on.
The same applies to every free calculator and checker on this site.
The CRM Marketing Assessment
The CRM Marketing Assessment is $1,500. The price is fixed and agreed before any work starts.
Delivery is ten working days from the day I receive the access I need. If access is delayed, that clock starts later.
Hire me to make the changes and the full $1,500 is credited. The credit applies once, to that work.
The credit is not a refund and is not transferable. It reduces the cost of the engagement that follows.
No guarantee of a result
I do not guarantee any revenue result. Nothing on this site is a promise of sales, growth or any other outcome.
Results depend on your product, your market, your list and what you choose to implement. Those are outside my control.
Any figure shown anywhere on this site is an illustration. It is not a forecast of what your business will earn.
Who owns the deliverables
Intellectual property in the deliverables transfers to you on full payment. Until payment clears, it stays with Marketing Engines, Inc..
That covers the written work produced for you. Examples are the assessment document and any templates built for your brand.
It does not cover my own methods, frameworks or tools. Those stay mine, and I reuse them for other clients.
You keep ownership of everything you give me. That includes your data, your brand assets and your account access.
Confidentiality
I do not publish what I did for you. I do not name your results, your numbers or your project anywhere.
Payment
Invoices are due on receipt unless the agreement says otherwise. Work may pause while an invoice is unpaid.
Limitation of liability
To the fullest extent the law allows, Marketing Engines, Inc. is not liable for indirect or consequential loss. That includes lost profit.
It also includes lost revenue, lost data and loss of business opportunity. It applies however the loss arises.
Total liability for any claim is capped. The cap is the fees you paid for that service.
Nothing here limits liability that cannot be limited by law. Fraud and personal injury are the usual examples.
The free tools are provided as they are. They carry no warranty of accuracy, availability or fitness for a purpose.
Ending the work
Either of us may end an engagement in writing. You pay for work completed up to that point.
Governing law
These terms are governed by the laws of the State of California. The courts of California have exclusive jurisdiction.
Changes
When these terms change, the date at the top changes. The terms in force are those published when you agreed them.
